SD Freedom Caucus Letter to Governor Noem Seeking Supreme Court Advisory Opinion

Rapid City, S.D. (August 17, 2023) – In light of Senator Jessica Castleberry’s recent resignation and ensuing agreement to repay COVID-relief funds, the South Dakota Freedom Caucus is now pressing Governor Kristi Noem in a formal letter for her to seek an advisory opinion, as is her authority in the SD Constitution, from the South Dakota Supreme Court on defining clear boundaries for conflicts of interest.

“The implications of Senator Castleberry’s resignation are unmistakable,” said South Dakota Freedom Caucus Chair Representative Aaron Aylward, “It’s imperative we bolster transparency and uphold integrity in public service.”

A revealing report from The Dakota Scout further complicates the situation, highlighting numerous state lawmakers or their businesses benefiting from over $600,000 in COVID relief funds.

“The facts from this investigative report are deeply unsettling,” said Freedom Caucus Vice-Chair Representative Tony Randolph, “As public servants, the onus is on us to ensure our personal and professional commitments remain separate and unambiguous.”

Adding more layers to this intricate issue is a document detailing further potential conflicts, accentuating the need for clearer legislative guidelines.

“Ambiguity in our legislative practices is a grave concern,” said Freedom Caucus Treasurer Representative Tina Mulally, “We must establish definitive ethical standards for public service.”

With an unwavering commitment to fostering public trust, the Freedom Caucus is rallying for the swift establishment of transparent guidelines. Freedom Caucus Vice-Chair Representative Tony Randolph further noted, “Our plea for an advisory opinion is rooted in the vision of a transparent and accountable governance system.”

In the quest for an open South Dakota, the Freedom Caucus earnestly requests Governor Noem to prioritize this advisory request.
